The following Terms and Conditions ("Terms") constitute a legally binding agreement between you (“User”, “you”, or “your”) and Janine Regan-Sinclair, dba The ONE Reset Method (collectively hereinafter referred to as the “Provider”, “we”, “us”, or “our”). By accessing this website (the “Site”) or by purchasing any professional services or digital audio and video recordings (“Services and/or Products”), you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.

Intellectual Property: Janine Regan-Sinclair exclusively owns all Site content, including "The ONE Reset Method" name, logos, graphics, images, and the “look and feel” and the content of all Services and/or Products offered through the Site. The Site content and the Services and/or Products content are protected by international intellectual property laws. Any unauthorized use, reproduction, or imitation of the aforementioned, in any form or medium, is strictly prohibited without express written consent.

Limited License and Prohibited Use: Upon purchase of Services and/or Products, you are granted a limited, non-exclusive, non-transferable, single-user license for your personal, non-commercial use only. This license does not constitute a transfer of ownership. 

Prohibitions: You may not redistribute, publish, copy, create derivative works, or commercially exploit any content from the Site nor the Services and/or Products. The use of any Site content or content from the Services and/or Products to train, develop, or feed Artificial Intelligence (AI) models or machine learning algorithms is strictly prohibited. 

Liquidated Damages: This Site and the Services and/or Products contain proprietary content developed through the Provider’s substantial expertise and investment. Unauthorized use of this content, including use for training, developing, or feeding Artificial Intelligence (AI) or machine‑learning systems, may cause significant harm to the Provider that is difficult to quantify and may not be fully compensable through traditional damages.

To avoid disputes over the calculation of such losses, you agree that, upon a breach of any of the above prohibitions, you shall pay liquidated damages of USD $25,000 to the Provider, representing a reasonable pre‑estimate of the harm likely to result from such unauthorized use. This amount is intended to be compensatory and not a penalty. This liquidated‑damages provision does not limit the Provider’s right to seek injunctive relief or actual damages if the harm exceeds the liquidated amount.

No Guarantees or Professional Advice: This Site and any Services and/or Products offered herein are for educational and personal growth purposes only. They are not a substitute for professional medical or psychological advice, diagnosis, or treatment. No representations, warranties, or guarantees, express or implied, are being made regarding any specific outcomes, results, or benefits from this Site and any Services and/or Products purchased through this Site. However, We shall not be liable for any indirect, incidental, or consequential damages arising from the use of this Site or our Services and/or Products. Our total liability is limited to the amount paid for the Services and/or Products in question.

You use the Services and/or Products at your own risk, and the Provider shall not be liable for any damages, adverse reactions or health complications resulting from your use of the Services and/or Products and you waive any and all claims against the Provider arising from your failure to seek professional advice.

Safety: Services and/or Products may involve deep relaxation, or altered states of awareness. You agree not to listen, to view, or otherwise use Services and/or Products while driving, operating a motor vehicle, or using machinery of any kind, and you agree to refrain from doing so for at least forty-five (45) minutes after using the Services and/or Products.

Prices: All prices are in CAD or USD and include applicable taxes. Prices are subject to change without notice. Payments are processed through secure third-party providers. By providing your payment information, you represent and warrant that you are authorized to use the designated payment method.

Final Sale: All sales of Service and/or Products are final and non-refundable once the download link has been provided or accessed.

Indemnification: You agree to indemnify and hold harmless the Provider and their respective associates, partners, employees, contractors, agents, representatives, successors, and assigns from and against any claims, damages, losses, liabilities, or expenses (including reasonable legal fees) arising out of, or in connection with, your use or misuse of this Site, your breach of these Terms, and your use or misuse of Services and/or Products. 

Anti-Association: You may not, and may not authorize any other party, to co-brand, frame or link this Site. If there are links to other websites which are not under our control, we have no control over the nature, content, and availability of those sites. The inclusion of any links does not necessarily imply a recommendation or endorsement of the views expressed within them.

Modifications to Terms: We may modify these Terms at any time. Changes will be effective immediately upon posting to the Site. Your continued use of the Site and/or Services and/or Products signifies your acceptance of modified Terms.

Governing Law: The Terms are governed by and construed in accordance with the laws of British Columbia, Canada and the federal laws of Canada applicable therein, without regard to conflict of law principles. You hereby irrevocably consent to the exclusive jurisdiction of the courts of British Columbia for any disputes arising out of, or related to, the use of the Site or the purchase of Services and/or Products.
